HB 1145 Summary

• Prohibits manufacturers from having any financial interest in wholesale alcoholic beverage businesses and prohibits manufacturers or wholesalers from having financial interests in retail establishments or furnishing retailers with anything of value

• Prohibits retailers from having financial interests in manufacturers or wholesalers, with an exception for producers of wine or distilled spirits not exceeding 250,000 gallons annually or beer not exceeding 3 million gallons annually

• Allows wholesalers to extend normal commercial credits to retailers, furnish beer containers and tap equipment (limited to $150 per tap per year), provide outside signs (up to $400), and provide miscellaneous materials (up to $100 per year)

• Exempts microbrew pubs from restrictions on co-ownership of manufacturer and retail licenses and allows brewers to have multiple taproom licenses while prohibiting them from having ownership interests in other manufacturers, brewers, importers, wholesalers, or retailers

• Violations constitute a class A misdemeanor for wholesalers, retailers, manufacturers, and retailers receiving prohibited benefits
