Changes the child restraint device requirement age from seven to eight years old, applying to children under eight years of age in motor vehicles.

Exempts children under eight who are at least 57 inches tall and weigh at least 80 pounds from child restraint systems, requiring only a properly fastened safety belt instead.

Expands the requirement for children ages eight through seventeen to use either an approved child restraint system or properly fastened safety belt while vehicle is in motion.

Allows children weighing more than 40 pounds to be restrained by lap belt only if the vehicle lacks lap and shoulder belts or all such belts are in use by other occupants.

Clarifies that violations of child restraint and safety belt requirements are not admissible as evidence of negligence in proceedings other than those charging the violation itself.
