House Bill No. 1325 Summary

• Amends North Dakota Century Code section 14-05-24 to establish the valuation date for marital property in divorce proceedings as the date mutually agreed upon by the parties.

• If parties do not mutually agree on a valuation date, the valuation date becomes the date of service of a summons in the divorce action or the date the parties last separated, whichever occurs first.

• Requires courts to compute the present value of social security benefits for the party with a government pension covered by the civil service retirement system to adjust the marital portion of that pension.

• Allows courts to redistribute property and debts in postjudgment proceedings if a party fails to disclose property and debts or fails to comply with court orders distributing property and debts.
