The commission must adopt rules by January 1, 2019, for implementing light-mitigating technology systems on wind energy conversion facilities, consistent with federal aviation administration regulations (14 CFR 1.1 et seq.), including service, maintenance, safety, and lighting requirements.

Wind energy conversion facilities with certificates of site compatibility issued after June 5, 2016, must be equipped with functioning light-mitigating technology systems complying with commission rules by December 31, 2019.

Wind energy conversion facilities with certificates of site compatibility issued before June 5, 2016, must be equipped with functioning light-mitigating technology systems complying with commission rules by December 31, 2021, with possible extensions granted after public hearing based on technical or economic feasibility.

All costs for implementation, operation, and maintenance of light-mitigating technology systems are the sole responsibility of the wind energy conversion facility owner.
