Parents may direct school districts not to administer state tests or state assessments required under section 15.1-21-08.

Parents may direct schools not to administer other specific tests or assessments, except this authority does not apply to tests required for grade completion or high school graduation, the ACT, or WorkKeys assessments.

Parental directives must be submitted using a standardized form prepared by the superintendent of public instruction, signed by the custodial parent, and remain valid only through the end of the school year in which received.

School districts are not liable for consequences resulting from parental directives and are not required to provide instruction or activities during administration of tests referenced in the directive.

School districts must report to the superintendent of public instruction on the number of directives received, directives applicable to economically disadvantaged students and specific demographic groups, and any funding losses resulting from the directives.
