Creates a new traffic violation for "failure to maintain control of a motor vehicle" when a driver commits any traffic offense while distracted or is involved in a reportable accident involving property damage while distracted.

Establishes a $100 fee for violations of the failure to maintain control offense and wireless communication device use (section 39-08-23).

Prohibits motor vehicle operators from using wireless communication devices to compose, read, or send electronic messages, with exceptions for voice-activated devices, GPS use, emergency calls, and hands-free operation.

Amends the definition of "moving violation" to include the new failure to maintain control offense and clarifies that "operation of a motor vehicle while distracted" means engaging in activities not necessary to operate the vehicle that actually impair or would reasonably impair safe operation.

Allows drivers cited for failure to maintain control to receive additional citations for any other traffic offenses committed in relation to the distracted driving violation.
