Amends the definition of "developmental disability" in North Dakota Century Code section 25-01.2-01 to explicitly include Down syndrome as an example of a mental or physical impairment.

Maintains existing criteria that a developmental disability must be manifested before age twenty-two, likely to continue indefinitely, and result in substantial functional limitations in three or more areas of major life activity including self-care, language, learning, mobility, self-direction, independent living, and economic sufficiency.

Requires the Department of Human Services to study developmental disability Medicaid waiver eligibility requirements during the 2017-18 interim, including analysis of assessment methods, tool reliability, and whether existing individual records can be utilized.

Directs the department to evaluate whether related conditions and specific medical conditions like Down syndrome should be incorporated into the waiver eligibility determination process.

Requires the Department of Human Services to report findings and recommendations to legislative management by April 1, 2018, including any proposed legislation needed for implementation.
