Department of Corrections and Rehabilitation's Division of Juvenile Services shall establish a pilot program to negotiate memoranda of understanding with federally recognized Indian tribes to accept and provide custody, care, and treatment for tribal juveniles adjudicated in tribal court.

Tribal governments must provide the department with tribal court orders, medical and psychiatric reports, law enforcement reports, and other pertinent referral information.

Department shall provide services based on individualized needs, maintain regular contact with tribes, and provide quarterly progress reports on each juvenile placement.

Department may limit the number of juveniles accepted based on departmental criteria and available resources, and may decline referrals or return juveniles if they pose institutional safety threats or fail to comply with departmental policies.

Department must report to legislative management before July 1st of each even-numbered year on the program's status, effectiveness, performance, and sustainability; act expires July 31, 2021.
