• Creates section 26.1-36-09.15 requiring all health insurers to provide coverage for telehealth services in the same manner as in-person services, effective when policies are delivered, issued, executed, or renewed.

• Defines telehealth as interactive audio, video, or other secure telecommunications technology for real-time or store-and-forward consultations, excluding audio-only telephone, email, and facsimile transmissions.

• Establishes that telehealth coverage may be subject to deductible, coinsurance, and copayment provisions consistent with in-person care requirements.

• Amends section 54-52.1-04.13 to require the Public Employees Retirement System board to provide equivalent telehealth coverage under its group insurance plans as provided under the general insurance requirements.

• Prohibits insurers from denying reimbursement for telehealth-delivered services that would be covered if delivered in-person, unless services are not medically necessary.
