Amends Section 40-08-09 to allow city council members in cities with populations of 500 or fewer to hold paid city employment positions if no other qualified individual is available at equal cost, subject to unanimous approval of other council members and documentation in official minutes.

Amends Section 40-09-17 with identical provisions for board of city commissioners members in cities with populations of 500 or fewer.

Preserves existing exceptions allowing council members and commissioners to serve as ambulance crew members or volunteer firefighters and receive compensation for training and emergency response.

Excludes appointed officer positions under Sections 40-14-04 and 40-15-05 from the new employment allowances.

Declares the act an emergency measure; passed by Senate 46-0-1 and House 86-5-3.
