• Creates chapter 5-05 of the North Dakota Century Code establishing a mandatory responsible alcoholic beverage server training program for alcohol retailers and their employees.

• Requires alcohol licensees to certify that employees who sell, prepare, dispense, or serve alcoholic beverages have completed attorney general-approved training within 30 days of license grant or renewal.

• Training curriculum must include alcohol's effects on the body and behavior, applicable laws, drinking and driving laws, intervention techniques for intoxicated customers, and carding procedures for underage drinkers.

• Provides that retailers who complete the training receive mitigating factors in liability cases for dram shop claims and in first violation enforcement actions by licensing authorities.

• Establishes certification valid for three years with mandatory renewal training; allows attorney general and local licensing authorities to reprimand, fine, or preclude non-compliant employees from working in licensed establishments.
