Exempts needles and syringes collected during needle exchange programs from drug paraphernalia laws under North Dakota Century Code chapter 19-03.4.

Authorizes the state department of health to approve syringe exchange programs operated by local health departments, cities, or authorized organizations in counties where viral hepatitis or HIV risk is present.

Requires programs to register annually and maintain oversight by a licensed pharmacist, physician, or advanced practice registered nurse.

Mandates programs provide overdose response training, referrals to HIV/hepatitis/STD services, drug addiction treatment information, and syringe distribution without collecting personal identifying information.

Prohibits law enforcement from stopping, searching, or seizing individuals based on program participation; prohibits state general fund monies for purchasing syringes; requires semiannual reporting to the state department of health on individuals served and supplies distributed and collected.
