Offenders under 16 years of age convicted of a crime must be transferred to the North Dakota youth correctional center by the Department of Corrections and Rehabilitation.

Offenders between 16 and 18 years of age may be transferred to an adult correctional facility only after an administrative hearing determines the transfer is justified based on departmental interests, safety of other residents, or public safety.

Offenders between 18 and 20 years of age may remain at the youth correctional center if the department determines it is in the best interests of both the department and offender and poses no safety risk to other residents or the public.

Offenders who have reached 20 years of age must be transferred to an adult correctional facility.

Youth correctional center offenders retain all rights to sentence reduction for good conduct and pardon and parole rights equivalent to adults in department custody.
