Changes North Dakota Century Code section 54-59-20 to make criminal history background checks discretionary rather than mandatory for Information Technology Department employees and contractors with unescorted physical access to department facilities or security-sensitive areas.

Allows the chief information officer to require background checks in accordance with section 12-60-24 for individuals employed by contractors or subcontractors with unescorted access to designated secure areas.

Adds discretionary authority for the chief information officer to require background checks for contractor and subcontractor employees performing information technology projects for the department or other state agencies.

Passed the House 68-24 (2 absent) and the Senate 42-3 (2 absent) during the 2019 regular session.
