Requires state engineer to complete initial review of dam, dike, or other device applications within 45 days, except in unique or complex situations.

Requires water resource board to review applications within 45 days and forward approval to state engineer; board silence equals no objections.

Allows state engineer to issue temporary permits for dikes, dams, or other devices in emergency situations.

Establishes that constructing dams, dikes, or devices capable of retaining more than 50 acre-feet of water (or 25 acre-feet for medium or high-hazard dams) without a permit is a class B misdemeanor and creates liability for all damages caused.
