HB 1137 Summary

• Allows insurers to deliver insurance notices and documents electronically via email or internet posting if the recipient affirmatively consents and meets specific requirements under chapter 9-16 of North Dakota Century Code.

• Requires insurers to provide clear disclosures before obtaining consent, including the right to withdraw consent at any time, procedures for obtaining paper copies, and hardware/software requirements for electronic access.

• Electronic delivery is equivalent to delivery by first class mail, registered mail, or other methods required by law, effective August 1, 2019.

• Permits insurers to post insurance policies and endorsements on their websites in lieu of mailing, provided the documents remain accessible during the policy period and for five years after expiration, with insureds able to print and request paper copies at no charge.

• Repeals section 26.1-39-26 of the North Dakota Century Code relating to electronic delivery of property and casualty insurance notices.
