The Commissioner of Insurance shall adopt rules consistent with and not more restrictive than the National Association of Insurance Commissioners' "Privacy of Consumer Financial and Health Information Regulation"

Rules may prohibit disclosure of nonpublic personal health and financial information without individual authorization, subject to exceptions including affiliate sharing provisions in the national model regulation

Insurance companies, nonprofit health service corporations, and health maintenance organizations are exempted from providing annual privacy notices if they comply with nonaffiliated third party sharing rules adopted by the commissioner

The exemption applies only if the organization has not changed its policies and practices regarding disclosure of nonpublic personal information from those previously disclosed to consumers in their most recent notice
