House Bill No. 1164 Summary

• Persons convicted of felonies and sentenced to drug court who successfully complete the program are deemed convicted of misdemeanors instead, with the exception of certain drug-related offenses under section 19-03.1-23.

• Persons convicted of misdemeanors under drug laws who are sentenced to drug court and successfully complete the program shall have their cases dismissed and files sealed in accordance with section 12.1-32-07.2.

• For third or subsequent DUI violations under section 39-08-01, all but ten days of the minimum mandatory sentence may be suspended if the defendant successfully completes an approved drug court program.

• Drug court programs are defined as district court-supervised treatment programs approved by the supreme court that combine judicial supervision with alcohol and drug testing and chemical addiction treatment in licensed treatment programs.

• The North Dakota Supreme Court may adopt rules and procedures for drug courts and drug court programs.
