HB 1165 Summary

• Creates uniform statewide standards allowing residential structures damaged beyond 50% of value to be repaired, replaced, or rebuilt without conforming to current zoning requirements if a building permit is obtained within 6 months and restoration begins within 1 year

• Rebuilt structures must not exceed the footprint, square footage, height, number of stories, or parking space count of the original damaged structure

• Prohibits expansion of nonconforming structures unless expansion complies with applicable state and local zoning regulations, as determined by local zoning authority

• Prohibits relocation of nonconforming structures unless the movement brings the structure into full compliance with all applicable zoning regulations

• Requires local zoning authorities to regulate repair and expansion of nonconforming structures in floodplain areas to maintain national flood insurance program eligibility and comply with floodplain management ordinances; permits local authorities to adopt less restrictive ordinances
