Schools must make up full days of instruction cancelled due to weather or only the hours/portions of hours lost for early dismissals, except school districts may apply for superintendent approval to use a virtual education plan instead.

School districts must include buffer days in their calendar equal to the average number of closure days from the previous five school years, calculated no earlier than January.

If weather closures exceed the budgeted buffer days, schools must reschedule remaining classes or offer approved virtual instruction with at least 95 percent student and staff participation to avoid making up missed hours.

Schools facing undue hardship from rescheduling may request the governor waive the requirement for state aid payment purposes, provided waivers are granted only for full days or accumulated partial days.

The superintendent of public instruction may adopt rules governing the submission and approval of virtual education plan applications and monitoring of approved waivers.
