• Prohibits political subdivisions (cities, counties, townships, solid waste management authorities) from adopting or enforcing ordinances that regulate, restrict, or impose fees on auxiliary containers (bags, cups, bottles, straws, and similar packaging).

• Defines "auxiliary container" as packaging made from cloth, paper, plastic, aluminum, glass, or similar materials used for transporting or consuming food, beverages, or merchandise at food service or retail facilities.

• Exempts from the prohibition curbside recycling programs, designated recycling locations, littering ordinances, and a political subdivision's or facility's use or regulation of containers on their own property.

• Updates definitions related to auxiliary containers in two North Dakota Century Code chapters (23-29 and 23.1-08) to align with the new restrictions.

• Effectiveness is contingent on certification that environmental health authority has transferred from the state department of health to the department of environmental quality, with different effective dates for different provisions.
