Amends North Dakota Century Code section 16.1-01-09.1 to prohibit recall of an elected official if the recall election would occur within one year of the next regularly scheduled election in which the official could be reelected.

Modifies section 44-08-21 to add clarification that an official whose office appears on a regularly scheduled ballot occurring within one year is not subject to recall if the recall special election would occur within one year of the next regularly scheduled election.

Maintains the ten-day resignation period for officials after the filing officer certifies a recall petition is valid and sufficient.

Preserves the requirement that other candidates for the office file nominating papers by the sixty-fourth day before the scheduled recall election.

Retains the prohibition against recalling an official twice during the term for which the official was elected.
