Amends North Dakota Century Code section 28-32-02 to prohibit administrative agencies from adopting rules that prescribe criminal penalties unless authorized by another chapter.

Reserves authority with the legislative assembly to determine when and if rules of administrative agencies are effective.

Allows administrative agencies to include in their rules descriptions of organizational functions, general operations, and procedures for public information requests and submissions.

Applies retroactively to void any rules adopted before the effective date that prescribe penalties in violation of this Act.

Passed with strong bipartisan support: House vote 88-1-5 and Senate vote 46-0-0.
