Driver who willfully fails to stop or flees from a pursuing police vehicle or peace officer upon visual or audible signal is guilty of a Class A misdemeanor for a first offense and Class C felony for a subsequent offense within three years.

Driver is guilty of a Class C felony if violating this section while willfully fleeing during or after the commission of a felony.

Driver is guilty of a Class C felony if operating the vehicle during flight or pursuit in a manner constituting an inherent risk of death or serious bodily injury to a third person.

A signal complies with the law if perceptible to the driver and given by hand, voice, emergency light, or siren from either an appropriately marked official police vehicle or by a uniformed officer or officer prominently displaying their badge.
