Amends North Dakota Century Code section 62.1-01-01(8) to modify the legal definition of machine gun, submachine gun, or fully automatic rifle.

Defines the firearm category as any firearm, mechanism, or instrument not requiring the trigger be pressed for each shot, with ammunition storage capability, capable of firing at a rate of five or more shots per second.

Explicitly excludes binary triggers from the definition, which fire one round upon trigger pull and one round upon trigger release.

Passed the House with a vote of 80 Yeas, 12 Nays, and 2 Absent; passed the Senate with 42 Yeas, 3 Nays, and 2 Absent.
