House Bill No. 1323 - Dangerous Weapon Definition

• Amends the definition of "dangerous weapon" in North Dakota Century Code section 12.1-01-04 to remove reference to firearms that expel projectiles by spring, compressed air, or compressed gas (BB guns, air rifles, CO2 guns).

• Expands the definition of "dangerous weapon" in section 62.1-01-01 to include knives with blades of 5 inches (12.7 centimeters) or more, throwing stars, and nunchaku, while excluding self-defense sprays/aerosols and voltage devices unless they use projectiles or multiple voltage applications.

• Modifies section 62.1-04-01 to clarify that BB guns, air rifles, and CO2 guns carried in a motor vehicle are not considered concealed weapons.

• Clarifies that "dangerous weapon" does not include spray or aerosol self-defense devices (CS or CN) or non-projectile voltage devices for self-defense, with exceptions for certain prohibited individuals.
