Creates new section 39-08-01.6 of the North Dakota Century Code allowing courts to seal criminal records for driving under the influence (DUI) convictions under sections 12.1-32-07.1 and 12.1-32-07.2.

Permits record sealing when an individual pleads guilty, nolo contendere, or is found guilty of a DUI violation under section 39-08-01 and has no subsequent DUI or other criminal offense convictions within seven years of the first violation.

Excludes individuals licensed as commercial drivers from record sealing eligibility under section 39-06.2-10.

Preserves prosecutors' access to prior DUI offenses for purposes of sentence enhancement under section 39-08-01, subsection 3, regardless of sealing.

Passed with bipartisan support: House vote 89-2 with 3 absent; Senate vote 45-2 with 0 absent.
