HB 1436 Summary

• Amends North Dakota Century Code section 24-06-29 to distinguish between permanent obstructions and temporary obstructions/traffic safety hazards within 33 feet of section lines or highway rights of way.

• For permanent obstructions, county commissioners or township supervisors must notify adjacent property owners by registered mail to remove the obstruction within 30 days; if not removed, the government entity removes it and bills the property owner as a tax lien.

• For temporary obstructions or traffic safety hazards, the responsible person receives a written order to remove them "as soon as practical"; if not complied with, the government entity removes them and bills the responsible party for costs incurred.

• Exempts railroad facilities from the temporary obstruction removal requirements and provides liability protection for individuals who remove snow or ice from section lines without causing damage or further obstruction.
