HB 1446 Summary

• Creates section 12.1-31-03.3 of the North Dakota Century Code requiring all electronic smoking devices containing nicotine liquid and nicotine liquid containers sold at retail in North Dakota to be labeled with the name and percent by weight of each ingredient.

• Defines "nicotine liquid" as a bottle or other container of liquid or substance containing nicotine that is sold, marketed, or intended for use in an electronic smoking device.

• Establishes a civil penalty of up to $500 for each separate violation for any person engaged in retail sales of non-compliant electronic smoking devices or nicotine liquid containers.

• Penalties are to be recovered by any enforcement authority designated by the city or political subdivision where the violation occurred.
