Department of Corrections and Rehabilitation shall establish a pilot program to negotiate memoranda of understanding with federally recognized Indian tribes for accepting and providing custody, care, and treatment of juveniles adjudicated in tribal court.

Department must require tribes to provide tribal court orders, medical and psychiatric reports, law enforcement reports, and other referral information, and must provide individualized services based on each juvenile's needs.

Department shall maintain regular contact with tribes regarding placed juveniles and provide quarterly progress reports, with more frequent reports if behavior warrants; may limit the number of juveniles accepted and may decline or return juveniles who pose institutional safety threats or fail to follow departmental policies.

Department of Corrections and Rehabilitation must report to legislative management before July 1st of each even-numbered year on the pilot program's status, effectiveness, performance, and sustainability, including recommendations.

Act expires July 31, 2023.
