Amends North Dakota Century Code sections 39-03.1-11 and 54-52-17 to change how final average salary is calculated for public employees retiring after December 31, 2019.

For employees terminating employment after December 31, 2019, final average salary becomes the higher of: (1) the amount calculated on December 31, 2019, or (2) the average salary earned in the three highest periods of twelve consecutive months during the last 180 months of employment.

Maintains existing calculation methods for employees who terminated employment before August 1, 2010, between July 31, 2005 and August 1, 2010, and on or after August 1, 2010.

Clarifies that months without earnings are excluded when computing the 36-month average used for retirement benefit calculations.

Passed the Senate 45-0 with 2 absent and the House 89-0 with 5 absent.
