Amends section 61-16.2-08 of the North Dakota Century Code to clarify permissible uses within flood fringe areas under the national flood insurance program.

Permits any use allowed in the regulatory floodway under section 61-16.2-06 within the flood fringe.

Requires residential structures to have lowest floors (including basements) elevated at least one foot above base flood elevation, unless granted a residential basement floodproof exception under the national flood insurance program.

Requires nonresidential structures to either be elevated at least one foot above base flood elevation or be adequately floodproofed to at least two feet above base flood elevation, following the more restrictive standards adopted by the community or state.

Passed the Senate 46-1 and the House 86-0 during the 2019 regular session.
