Designates present use and disposal of coal combustion residuals as acceptable under North Dakota law, permitting beneficial use in concrete, construction applications, and other innovative uses without hazardous waste classification.

Allows the state to pursue primacy of any federal coal combustion residuals program without being prohibited by this section.

Establishes citizen suit provisions permitting persons with adversely affected interests to commence civil actions to compel compliance with coal combustion residuals regulations.

Requires 60-day notice to the department and alleged violator before any citizen suit may be filed for coal combustion residuals violations.

Grants interested persons the right to intervene in civil actions brought by the department to enforce coal combustion residuals compliance.

Takes effect August 1, 2019, contingent upon certification that environmental health authorities have transferred from the state department of health to the department of environmental quality.
