Amends permit appeal procedures to require appellants to have participated in or provided comments during the hearing process and restricts challenges to issues raised during the permit hearing process.

Permits facilities required to obtain permits under hazardous waste management rules that existed on July 1, 1981, or when regulatory changes took effect to be treated as issued permits until final administrative disposition of their applications.

Changes administrative action procedures for environmental quality matters to follow North Dakota Administrative Code chapter 28-32 instead of article 33-22.

Establishes minimum permit fees for special use waste solid waste management facilities: $20,000 for facilities receiving 100+ tons per day and $10,000 for facilities receiving 10-100 tons per day.

Repeals section 23.1-06-03 and chapters 23.1-09 and 61-30 of the North Dakota Century Code and declares the act an emergency measure effective upon filing with the Secretary of State contingent on certification that environmental health authority transfers from the State Department of Health to the Department of Environmental Quality are complete.
