Amends North Dakota Century Code section 23-12-10 to create an exemption from smoking prohibitions for bars and cigar lounges that meet specific requirements, including possession of a valid tax department certificate, a humidor on premises, solid enclosure with ceiling and door, and ventilation system that prevents smoke recirculation.

Allows smoking of cigars purchased on premises only; prohibits smoking of any other products in exempt bars and cigar lounges.

Requires bars and cigar lounges to report annual cigar sales revenue to the tax department before February 1st each year, with bars generating at least 10 percent of gross income from cigar sales and cigar lounges generating at least 30 percent.

Defines "cigar" as an individual roll of tobacco with whole leaf wrapper and cover, containing only tobacco filler and binder, no additives except water, no filter or mouthpiece, weighing at least six pounds per thousand count, and made by hand or with manually operated machinery.

Maintains prohibition on retaliation against employees for asserting smoking-related rights and prohibits smoking where otherwise restricted by law.
