Senate Bill No. 2225 Summary

• Amends section 14-09-10 of the North Dakota Century Code to limit creditor recovery for necessary health services to cases involving disqualifying asset transfers or bad faith actions by parents or adult children.

• Creditors may recover for health services (medical and long-term care) only if the defendant received a direct benefit from a disqualifying asset transfer within five years of receiving services, and recovery does not exceed the fair market value of the transfer.

• Allows creditor recovery against parents or adult children who acted in bad faith by misappropriating, misusing, or diverting income or assets to prevent payment for necessary health services within five years of service receipt.

• Repeals section 50-01-19 of the North Dakota Century Code relating to familial duty to support for county welfare.

• Applies to collection actions that become final on or after the effective date and is declared an emergency measure.
