Amends subsection 5 of section 49-22-08 of the North Dakota Century Code regarding commission designation of sites and corridors for proposed facilities.

Designations must be made no later than six months after filing a completed site compatibility application or three months after filing a completed corridor compatibility application, with extensions allowed for just cause.

Commission failure to act within specified time limits does not divest the commission of jurisdiction in certification proceedings.

Prohibits the commission from conditioning certificate or permit issuance on applicants providing mitigation payments requested by other state agencies or entities to offset negative impacts on wildlife habitat.

Passed the Senate 41-6 and the House 81-12 in the 2019 regular session.
