SB 2262 Summary

• Defines "payment card," "re-encoder," "scanning device," and "skimmer" for purposes of North Dakota criminal law related to electronic payment fraud.

• Makes using or attempting to use a skimmer, re-encoder, or scanning device to obtain information from a payment card, driver's license, or state ID without permission a class B felony; second or subsequent violations are class A felonies with civil penalties up to $100,000.

• Expands the definition of "personal identifying information" under unauthorized use laws to include payment card information, biometric data, photographs, email addresses, usernames and passwords, and other financial access information.

• Establishes that possessing a skimmer, re-encoder, or scanning device with intent to commit or aid unlawful activity is a class A misdemeanor.

• Repeals the previous section 12.1-23-17 relating to unlawful card skimming and consolidates related provisions into updated law.
