Amends section 12.1-01-05 to clarify that state law crimes may not be superseded by city or county ordinances, except as provided in section 40-05-06.

Allows cities and counties to still enact ordinances with penal language when otherwise authorized by law.

Amends section 40-05-06 to permit cities to establish fees for violations of motor vehicle operation, equipment, and traffic ordinances up to one hundred percent above the limits set in section 39-06.1-06.

Excludes ordinances listed in section 39-06.1-05 from the fee increase allowance.
