Amends section 44-04-18.4 to add the state department of environmental quality to records exempt from disclosure, alongside existing exemptions for trade secrets, proprietary, commercial, and financial information.

Creates new subsection 7 exempting records received or distributed by the state department of emergency services and state local intelligence center for emergency, disaster prevention, protection, mitigation, response, and recovery purposes from public disclosure.

Exempts cybersecurity information and critical infrastructure records from disclosure when their release could expose or create vulnerability of critical infrastructure systems including telecommunications, electric, water, sanitary sewage, and energy systems.

Establishes that records originating from federal agencies must be referred back to the federal agency for disclosure requests under applicable federal laws rather than being released under state public records law.

Enacts new subsection 6 of section 44-04-18.10 providing that emergency-related records remain confidential or exempt even after being required to be disclosed to another entity for emergency planning and response purposes.
