Nursing facility beds may not be added to North Dakota's licensed bed capacity between August 1, 2019, and July 31, 2021, with exceptions for reverting basic care beds to nursing facility beds.

Nursing facilities may reconfigure licensed nursing facility bed capacity no more than two times in a twelve-month period, increased from one time.

Nursing facilities may delicense up to 30 percent of licensed nursing facility bed capacity and hold it for forty-eight months, with a maximum total delicensed capacity of 50 percent of currently licensed beds.

Delicensed bed capacity may be relicensed after six months, transferred to other entities, or licensed as basic care beds, with basic care beds reverting to nursing facility status after twelve months if not transferred.

Transfers of nursing facility bed capacity between entities are permitted with a seventy-two-month licensing period; beds transferred as basic care capacity may never be reverted to nursing facility beds.
