Amends North Dakota Century Code section 23-12-10 to create an exemption from smoking restrictions for bars and cigar lounges that meet specific requirements including valid tax commissioner certification, on-site humidor, solid enclosure with ceiling and door, and proper ventilation system.

Requires bars to generate at least 10 percent of annual gross income from cigar sales and cigar lounges to generate at least 30 percent of annual gross income from cigar sales to qualify for the exemption.

Establishes that only cigars purchased on the premises may be smoked in qualifying bars or cigar lounges; smoking of any other product is prohibited.

Requires certified bars and cigar lounges to report annual cigar sales revenue as a percentage of gross income to the tax commissioner before February 1st each year to maintain their certificate.

Maintains protections against employer retaliation for employees asserting smoking restriction rights and clarifies that employees working in smoking-permitted settings do not waive legal rights against employers.
