HB 1164 Summary

• Legislative management may review any presidential executive order not affirmed by Congress and signed into law, and recommend to the attorney general and governor that it receive further review.

• Upon recommendation from legislative management, the attorney general shall review the executive order for constitutionality and determine whether the state should seek an exemption or challenge it as an unconstitutional exercise of presidential authority.

• State entities, political subdivisions, and publicly funded organizations are prohibited from implementing an executive order if the attorney general issues an opinion that it unconstitutionally restricts rights or if a court finds it unconstitutional.

• The prohibition applies to executive orders relating to pandemics or health emergencies, natural resources regulation, agriculture industry regulation, land use, financial sector regulation regarding environmental or social governance standards, or regulation of the constitutional right to keep and bear arms.
