Department of Corrections and Rehabilitation must file a petition to terminate probation for individuals who have served the longer of 15 months or the minimum mandatory probation period, excluding those convicted of offenses under chapters 12.1-20 or 12.1-27.2 or participating in drug court.

Probation termination requires that the individual has not had probation revoked and has not been subject to intermediate measures during the six-month period before the petition filing.

Individual must have no pending extraditable criminal charges and be in satisfactory compliance with restitution and reparation, if applicable.

If the prosecuting attorney does not file a petition for hearing within 30 days of the termination petition filing and the court does not schedule a hearing within 45 days, the court must issue a final discharge from supervision.
