Employees may opt-out of employer-mandated face mask, face shield, or other face covering requirements by submitting either a physician's certificate stating the covering would endanger their health or a signed statement of religious, philosophical, or moral opposition.

Opt-out provisions do not apply to employees in positions where the employer determines face coverings are essential due to the nature of the employment setting, provided the reason would have been applicable before January 1, 2020.

Employers must provide reasonable accommodations to employees who opt out based on religious beliefs, consistent with North Dakota employment law section 14-02.4-03.

The act is effective through July 31, 2023, and becomes ineffective after that date.

The bill is declared an emergency measure.
