State health officer may issue temporary orders for emergency reporting of disease conditions without chapter 28-32 approval for up to 90 days, with emergency rulemaking required within 90 days or the order expires.

When the governor declares an emergency or disaster based on an epidemic, the state health officer or health council shall consider whether to issue orders or adopt rules to designate infectious diseases as reportable diseases or post-mortem communicable diseases.

No person may remove an individual with a reportable disease or condition, or the body of an individual who died of such disease, across state lines, between buildings, or on vehicles without a permit from the local board of health or state health department.

Health council may adopt rules directing the state health department to notify emergency medical services personnel about the presence of reportable diseases and persons taking possession of dead bodies with post-mortem communicable diseases.

Rules adopted during epidemics may disclose personally identifiable information notwithstanding other state privacy laws.
