Creates a sports wagering commission as a division of the attorney general's office to regulate retail and mobile sports wagering in North Dakota with five members (three appointed by attorney general, two by governor).

Establishes licensing requirements for retail sports wagering operators (maximum 2 licenses), mobile sports wagering operators (maximum 3 licenses), participating retail locations, and suppliers, with application fees ranging from $2,000 to $50,000 and renewal fees from $1,000 to $10,000.

Imposes sports wagering taxes of 6.75% on net revenue from retail operations and 10% on net revenue from mobile operations, with quarterly payment requirements and allowances for negative net revenue carryover.

Requires criminal history background checks for all applicants and persons with control of applicants or licensees, conducted statewide and nationwide per section 12-60-24.

Establishes penalties for unlicensed sports wagering: class B misdemeanor for first violation, class A misdemeanor for second violation, and class C felony for third or subsequent violations; civil violations subject to fines up to $10,000.

Makes the act effective August 1, 2023, contingent on voter approval of House Concurrent Resolution No. 3032, and directs legislative management to study sports wagering during the 2021-23 interim.
