Class B misdemeanor for entering another's property and surreptitiously gazing, staring, peeping into, or installing devices for observing, photographing, recording, amplifying, or broadcasting sounds or events from a house or dwelling.

Class B misdemeanor for surreptitiously gazing, staring, peeping into, or installing devices for observing, photographing, recording, amplifying, or broadcasting in tanning booths, hotel sleeping rooms, or other places where a reasonable person would expect privacy.

Infraction for installing wildlife observation, recording, or photography devices on another's property without written permission and without a permanently affixed tag containing a game and fish department registration number or the individual's name, address, and telephone number.

Affirmative defense available if the individual was acting pursuant to section 50-10.2-02.1.
