HB 1318 Summary

• Each school district must adopt a written restraint and seclusion policy by July 1, 2022, that prohibits seclusion, mechanical restraint, and chemical restraint for all students in prekindergarten through grade twelve.

• Physical restraint is prohibited except when a student's behavior poses imminent danger of serious physical harm and other less intrusive interventions have been attempted unsuccessfully or deemed inappropriate.

• Physical restraint is banned in face-down positions, positions that impair breathing or communication, positions placing pressure on head/neck/torso, and positions obstructing the student's face from staff view.

• School district personnel must receive annual professional development and training in positive behavior interventions, trauma-informed practices, crisis de-escalation, restorative practices, and behavior management.

• School districts must submit annual reports to the superintendent of public instruction beginning July 1, 2023, documenting restraint and seclusion incidents, affected students, and whether students were on an individualized education program or 504 plan.
