Court shall seal an individual's criminal record for a conviction under section 39-08-01 (driving under the influence) if the individual pleaded guilty, nolo contendere, or was found guilty of the violation.

Record sealing is available only if the individual has not pleaded guilty, been found guilty, or pleaded nolo contendere to any subsequent violation of section 39-08-01 or any other criminal offense within seven years of the first violation.

Commercial drivers licensed under section 39-06.2-10 are excluded from record sealing provisions.

Prosecutors retain access to prior driving under the influence offenses for purposes of enhancement under section 39-08-01, subsection 3.

Act applies retroactively to all prior convictions meeting the eligibility criteria.
